Looking for advice
I filed for vawa in March 2022 after I separated for mi ex husband I 2021 (The process for my previous marriage, my i130 was approved, I was just waiting for the interview, before I separated and divorced), after all this time I got engaged in June 2023, my lawyer told me that I can't get married again until my i360 get approved. Fiance and I have talked about the possibility of getting married and doing the entire immigration process again through him. I spoke with two lawyers, one told me that I could do it without a problem and the other told me to wait because VAWA would probably be approved in 24 to 36 months. There are many personal factors (his job) as to why we cannot wait that long. Has anyone filed the i-130 twice?

I never done it but I think the only reason a lawyer will tell you not file marriage based green card again is the possibility of raising red flag since it’s only roughly 2 years since your other divorce. The immigration might think you are marrying for a green card but honestly people have been approved for far worse. Hope you find a solution. good luck

i suggest you finish your Vawa because people's minds change like day and night comes. My soon to be ex husband promised me the moon and started my i-130 and then i woke up to someone who suddenly didn't want me to be independent. now i am on vawa with our infant daughter. people's minds change. Becareful!

I would suggest you to wait for your vawa like everyone else stated.

I’d wait for my 1360 to at least approve. Tbh the you never can tell what the actual outcome for the second can be, if you cancel and go through with it. but you are half way why not wait till you get your vawa approval then you can get married while waiting for the adjustment process to approve…. I’m in the same boat as you and I had to keep begging my man to wait till this process is over so we can get married .

@Akin10 10 do you have your GC now?

@G C I agree with @God Bless because what would you do if your new husband starts acting up? file VAWA again for the second time? if your fiancé loves you the. let him wait! he can put a ring on your finger and you guys can live together and all. marriage is just a piece of paper! you’re already half way through so you might as well wait

My ex said she would apply it for me and promised the whole world. My attorney said to keep my VAWA application - I was tired of waiting too - My ex and I broke up last year and my green card got approved this year

In my opinion, I would rather wait for VAWA to go through.

@G C learn from @s s story. wait or you’d have yourself to blame! especially if you have EAD and you’re already working! what’s the rush? Im currently engaged and applied for VAWA a year ago. we currently live together and he has offered severally to file for me again and I said NO! like someone said earlier, people’s mind change like the weather! I derive joy going to sleep every night knowing that my application is in my hands and not someone else’s! I can work and can travel with EAD & AP! that’s all you need in the meantime! especially now that they are giving 5yrs combo card

What @God Bless said 💯
I know you probably in love right now, I hope everything works out for you guys but, please, think of yourself first. Finish your process, get your documents then marry again.

@G C Don't put your faith in other people's hands. You shouldn't trust anyone completely.

@s s you see! my abusive husband has taught me alot. i can not go another route but Vawa all the way. They trap you with promises
s s11 de abr de 2024
@God Bless that teaches us to not trust nobody else but us!
my ex even threated me to go to my ex wife and tell her that I had a VAWA process “against her” and was gonna call immigration to let them know that I was lying about my application. I promised myself I would never open up to another relationship at the beginning.

@s s yes please. its horrible what we go through and worst off without proper paperwork
