I don’t think there’s a set rule for timing when it can be filed, mostly 2 years is what the rule of thumb looks like. But I have come across posts where people filed anywhere from 3 months - 18 months - depends on each case. I filed my i140 and i485 concurrently in March 2024, a series of rfe denias i290b’s my 140 was approved August 2025 and 485 reopened Sept 2025.

@freeman 1 did your friend get approved? any interview or rfe after mandamus ?

y@Alex brown yes after 3 days they sent RFE and after a week he got interviewed got approved a week later

I got an update today!! Case transferred and new office has jurisdiction. DOJ was served yesterday morning, none of others are even served yet and this happened in 1 day.

@Amin Goretz summons has issued from court. now 60 days time period to response from USCIS.

No updates after the NBC transfer update.

@D Kat congratulations. My summons were issued on 29 December, after that no update yet. file date 23 December. how long does to take serve ?

@Alex brown Totally depends on the type of post.We used USPS 2 day one and all of them were delivered within a week. The local one was delivered the next day itself and that started action for my case.

@D Kat my lawyer replied me like this : We have sent them to each defendant and the U.S. attorney by certified mail. The Federal Rules require us to send them this way. We do not have the option to send them via expedited mail. do have any idea how long does it takes serve in my condition?

@Alex brown Yes Certified mail is the same, it should take anywhere from 1-5 days maximum. Mine delivered Dec 17, Dec 18, 2 on Dec 19 and 1 on Dec 22. Also once delivered I submitted the proofs to the court that summons are delivered.

@Alex brown Unfortunately, no. Case monitor only shows any status changes to your case, mandamus is different. Your attorney should be able to share the usps tracking numbers with you.

update: today me and my wife got letter from local field office. I don’t know yet what kind of letter is it. Is it medical rfe or interview notice? we both done interview last year.

when we your pd? my pd is april 2021 can i do it?
