don’t understand. I thought a green card holder couldn’t file Form I-765 or Form I-485 until the Form I-130 is approved. Can you explain how that’s possible? From what I understand, a green card holder usually has to wait for a visa number to become available before filing Form I-485. Since Form I-765 is based on a pending I-485, I thought the I-765 couldn’t be filed either until the I-485 is eligible to be filed. Can you help me understand how someone can file the I-485 and I-765 before the I-130 is approved? Is there an exception, or am I missing something?

@Noah Henry In my case, my husband is a lawful permanent resident, so I’m in the F2A category. Normally, an F2A beneficiary cannot file the I-485 until a visa is available, but the I-130 does not necessarily have to be approved first. When I filed in October 2025, my priority date was current under the USCIS filing chart, so I was eligible to concurrently file the I-485 while the I-130 was still pending. My I-765 was then filed based on the pending I-485 under category (c)(9). So it wasn’t an exception, the visa availability requirement was satisfied at the time I filed
