good for you!! congrats!! did you get any RFE? why it took so long?
P C3 de oct de 2024
no RFE. our case was not straightforward AOS case. we had pending asylum as legal status.

@P C I currently have a pending asylum application and recently attended my interview(eb3). Just a week after the interview, I received a Request for Evidence (RFE), which I haven’t responded to yet. My lawyer believes there’s a 99% chance that USCIS will deny my I-485 application because they consider asylum as not being a lawful status.
Could you share how your AOS case got approved? Was there anything specific you did to strengthen your case or address any issues that came up?
P C5 de oct de 2024
@EB3333 Unskilled our interview questions were 90% about my husbands job related. the only question related to asylum was if is still pending and being in a pending asylum is the discretion of the officer to approve or not since this is a gray area.

@P C did you guys have any other status, besides the pending asylum? I was in the same boat, but my case got denied...
MP M20 de mar de 2025
@EB3333 Unskilled any updates, what did you end up doing
Einar Adam27 de jul de 2025
@P C Did you use a lawyer and what field office because I heard it depends on the field office some have an internal policy to deny such cases and others don’t.
Lulu N16 de abr de 2026
@Einar Adam are you a nurse? other than asylum did you have any other?
Einar Adam17 de abr de 2026
@Lulu N I’m an engineer and actually my greencard application based on EB2-niw was approved back in November 2025
Lulu N17 de abr de 2026
@Einar Adam did you have pending asylum? which lawyer helped you? im a nurse, im current but choosing consular processing with advance parole over i485 due to the denials I've seen. I also have pending asylum.
Einar Adam18 de abr de 2026
@Lulu N yes I had a pending asylum. my lawyer told me it’s 10% chance it all depends on the officer and the office policy. Mine ended up in Buffalo NY and got approved in about three months. To be honest, my lawyer didn’t do anything special and her strategy was basically to not draw attention to the pending asylum so she just wrote a page of legal brief. If you have the option to go abroad do it, it’s safer than AOS but I didn’t have a passport so I had to do AOS as my home country passport was expired.
Lulu N19 de abr de 2026
@Einar Adam wow thats great, kindly send me your lawyers contact. Did you apply for asylum after before your i94 expired? do you mind sharing the legal brief with me? or state some points here?
Einar Adam20 de may de 2026
@Lulu N if you still need some info. share your contact info here and I’ll share what I have
