I-485 denied
my I-485 was denied. today because I didn’t know my husband withdraw the I-130 without any noticed, we are not longer living together but we have a daughter and I’m the only one supporting her as he never gives me anything, I will appeal the decision but at this moment I don’t know what to do. I’m in tears. does this happened to any of you ?? how long until everything resolved ?

There is nothing you can do if he made the withdrawal on I-130

i am so sorry Annie. I would definitely consult with a lawyer. If you went into the marriage in good faith and have a child you should have a way to get status. I think similar situations people have done VAWA which can take a long time. wishing you all the best.

yes unfortunately only VAWA will work, emotional abuse will also suffice if you can prove it.

you cannot appeal the decision. But what you can do its to file for VAWA. You need to see a lawyer for that or file yourself if you do not have the money but after doing a detailed research about Vawa and the documents you need.

@Annie G I would like to join in and let you know I feel for you in this situation. This community is a great source of support. It was a real calculated move on your husband’s part. Don’t give up hope, there is always a blessing in the storm. I would contact a lawyer, explore and exhaust all your legal options. You can do this.

Woooww I'm speechless!!!! And here I am complaining about my boring life..!! May GOD help you in this difficult time! Listen I think you should find a way to get some type of financial support from your ex husband (child support). It's his duty and mandatory. Then, with a Social Security Number SSN you open an online business for example to support yourself. Now, please don't look back, find yourself someone who truly loves you and who's willing to go through the whole process again by refiling a new case!!!! That's my best advice for you. It is never too late, as long you and your future husband do not have any criminal records. Good Luck!! You can do it Mama.💪❤️❤️ Ps: Lawyers don't always help. Most of them are money greed. However you can book a 1h videoconference with some of them through this app to ask questions about your options. I don't recommend VAWA if there were no violence neither an appeal. you'll waste more time and money in it.
