i-140, EB-2 NIW case pending more than 900 days
Requested premium processing in October 2021, which is declined. What’s wrong with USCIS? Is it possible to sue the USCIS for their mockery relationship with the petitioners like me?

I thought premium is not available for NIW. did they accept the premium fee?

Hi Phil. I think you can do an inquiry since this is over the processing time reported by USCIS. Talk w/ your lawyer about.

No, premium processing fee not accepted. They sent me a receipt that I’m not eligible for the premium processing.

And I keep sending request to USCIS that my case is outside of the processing time and they keeps answer the exactly same sh*t all the time.

I work for a multi billion dollar corp and our attorney advised against litigation even though the company was willing to pay the expenses
going through your senator or congressional rep is probably better

NIW doesn’t have premium processing option!

Thank you Chirag. I’ll try to reach the Florida’s Senator. I’ve filed EB-2 NIW based on my doctoral degree in computer science.

@ Kh A Thank you very much for your concern and advices. Yes, I prepared my case myself. And certainly provided all evidences and documents accordingly. Spent more than 6 months to prepare my paperwork.
