I-130 Approved But Confused.
I applied for both my wife and step-daughter on the same form. On the approved letter, for the beneficiary, only my wife name is on it. Does it mean that only my wife will go through all the process and join me in the state very soon? My step-daughter is only 4 years old. What should I do in a matter like this?

@ep pe and waiting waiting, should I fill out a new application for my step-daughter? But on the application, I wrote her name and even provided her birth certificate with the application I filled out for both.

@annela annela, I will do it ASAP. But when I do, and attached her mom approved letter, will USCIS approved her fast because of her age? Will both of them have interviews the same day and migrate to the state, same day? she can’t migrate to the state alone.

I think it’s best to ask an immigration lawyer or call USCIS.. because from my understanding the process for step children is usually 1 1/2 years or 2 years.. but like I said try to get advice from a good immigration lawyer.

if you’re a citizen you have to fill it separate. two application. I can explain you if you want . I did the same all by myself. without a lawyer

@A&M KAM so you would have to fill out and pay for 2 separate applications. From my experience I had to wait the time allotted for her application and then you can expedite it. Let me look for the info NVC gave me but you can call and ask for yourself

@A&M KAM I cannot find the email but you can call them and they will give it to you, either try early morning or late evening since they are open until 11 or 12pm

oh also @A&M KAM they will say your wife does not have to leave right away( that’s what I was told lol) so they will not or I should say may not expedite it as soon as you put it in

this happened to me as well, if you are a citizen you have to file 2 separate I 130 forms, however If u are a resident the child can be on the one i130 as a derivative of the mother. I learned that when I went on my green card interview when I asked the agent about my daughter. she also told me to let my husband file for her it will be faster. we submitted her paperwork in june 21 now waiting on her interview date.

@k b, thanks for the great information, on Tuesday or Wednesday, I will try calling both USCIS and Visa center, ask them about this matter. If required to fill out another application, I will. I pray and hope that it get approved fast.
