i94 would not effect since you already applied you have to apply and tell them to hold the i485 in abeyance until you get your vawa approved

then you have to wait until vawa gets approved, cz as far as I know ppl who files i30 and i485 together can hold the i485 until it gets approved

you can file i485 anytime after vawa, that’s exactly what I did. I file my vawa in April 2020 and I file my i765 and i485 in march 2021

if you have pending i485 base on your marriage, you need to withdraw that one because your spouse is petitioning that for you and file your own by yourself, then uscis will waive your filing fees

no, you don't need to withdraw it, after vawa is approved then it gets adjudicated. I still have it pending just gave fingerprints

@home boy I just did my fingerprint two days ago for the first time in states. i hope I get EAD. do you know how long it takes to issue ead affer fingerprint. my application been pending for 11 months

no no, fingerprint for actual application. I did fingerprint for criminal record before applying.

@s nos, if you have interview base on your spouse petition, go for the interview and tell the officer you have already put in for vawa

@anno I tried that and they told me to contact the airport of which I entered the country but they want me to come there and speak with immigration (NO THANK YOU) I’m not going last thing I need is to be detained right now I was told to just send it in I already requested to get my A file from USCIS so I’ll just wait and I’m the mean time I’ll send my I485 in

another question @home boy on the I485 did you submit 2 passport size photos with your application?

@anno it still is showing it's processing so idk how will it be rejected. I applied combo together in august 2020 then applied i360 on October so I am confused they just took fingerprints on my i765 and i485 and got the intveiww scheduled soon too

@anno semmio a immigration lawyer told me today you don’t have to because you have 2 years in which to file you just need to submit copies of your pending I360 and I765 receipts

@anno I think you are having it wrong I did not submit a I130 or I485

I submitted my I360 along with my I765

I did a straight VAWA petition there was no application sent before my VAWA

and I did it all by myself doing my reaches and so far I haven’t made any mistakes on my applications I am on my second prima facie and I just received a letter to do my biometrics

so I sent the files twice and somehow USCIS missed it so in between they asked everything in one rfe I guess they are satifisfied with whatever they have for now. my lawyer said it simply means they have received any information regarding my i360 and they are viewing it. trust me you're approved just wait until they issue your c31 or approval letter yorue closer to an end of it. did you have any interview for i485 yet?
