H1b approved but spouse on F2
Hi My H1-b has just got approved and my sevis ID has been canceled, when I applied for h1-b I didn't apply for spouse and hence she is still in F2 status. My question is that since the primary is not on f1 has she gone out of status? is there a grace period where I can apply immediately for h4, is she recurring unlawful presence days until then?

F1 is dependent of F2, if you are no longer F1 then F2 is cancelled

spouse cannot be in F2 if there is no F1, file immediately for H-4

You need to speak with an immigration attorney asap. She may need to leave to get the H4 from a US consular since it is now out of status. It is a common mistake that all family didn’t apply all together.
