EB3 India GC Approved (Finally after 11 years!!!)
It’s been quite a journey since 2010 waiting for GC, knowing it’s out there and I get it one day. Moving onto next level of my life wishing everyone good luck with your cases.

congratulations 🍾🎊🎉
D 18021 de jul de 2021
Congrats. What was your status while waiting since 2010?
Cubby P21 de jul de 2021
@D 180 H1-B
Cubby P21 de jul de 2021
@Ingrid Appreciate it sir!
ser kan21 de jul de 2021
congrats! what’s the field office?
D 18021 de jul de 2021
@cubby I see. and was there ever an issue with the H1-B renewal? Did it renew in 3-yr increments?
Cubby P21 de jul de 2021
@ser Thank you. FO is Hartford, CT. But I highly doubt, it ever went there since all notices, RFE from NBC including the Cards, Apporval notices.
ser kan21 de jul de 2021
nice!
Cubby P21 de jul de 2021
@D I personally never had any issues and it renews every 3 years with approved I-140. Otherwise max limit is 6 years. So within these 6 years either you file for GC or Leave or change status to something else!
V C21 de jul de 2021
did you had an interview?
Cubby P21 de jul de 2021
No, Interview was scheduled but then cancelled since Application is approved so kind of waived!
V C21 de jul de 2021
was it a RFE for medical?
Cubby P21 de jul de 2021
Yes sir! The stupidest mistake not sending the medicals with I-485. I blame our attorney for it 😉. Wasted 2 months at minimum.
V C21 de jul de 2021
same here. submitted 485 in 8/31/2020. RFE response submitted for medicals on 2/25/2021 and no response since then. priority date is July- 2011. upgraded to eb1 from eb2 in 2020

Reach out to congressmen for help!
V C22 de jul de 2021
not sure if it helps. the processing times at each service center/ field office are 9 to 30 months on uscis website.
Cubby P22 de jul de 2021
Sure it helps. Try congressmen and also e-request. Don’t be fooled by the processing times though, those are benchmark times for average applications not a real timeline. Most people getting GCs within 9 months especially for EB, they are waiving interviews so you have better chances. Don’t wait!
V C22 de jul de 2021
sponsor in EB cases is an employer. the applicant continues to work for the employer on a work visa. when green card is approved for the applicant the status changes from work visa to permanent resident. the employer/ sponsor has nothing to lose here nor is the employer waiting on anything.
V C22 de jul de 2021
in a nutshell- foreigners either need to have work visa or green card to work. the easiest way to work for an employer is to get work visa sponsored from a prospective employer. however a visa is not permanent. so people
file for a green card thru that employer. Until the green card is approved, work visa can be renewed to legally work in the US
V C22 de jul de 2021
yes - a company should be willing to sponsor work visa for you and later on file GC.
V C22 de jul de 2021
eb1, eb2, eb3 are different categories of employment based green cards. the individuals are able to stay in US legally on a work visa called as H1-B. again there are lot of categories of employer sponsored work visas.
V C22 de jul de 2021
you won’t understand the entire employement based immigration in 1 or 2 posts here. either google or reach out to lawyer
V C22 de jul de 2021
there could be someone sponsoring GC directly but which employer would be willlig to wait for years until GC is approved. GC approval also depends on nationality. especially for folks form India there is already a decade long backlog. which employer will sponsore GC directly and wait for 10 years.
V C22 de jul de 2021
as I said depends on country of birth. check/read the table info in visa bulletin that says current. I am pretty sure it neither India nor China
