I went through same process and the case officer from field office denied the case without any interview, no RFE & no NOID. Direct denied. Reason of denial "Pending asylum is not Lawful status". My I-94 was expired when i applied for asylum. I was allowed for 2 weeks in USA by CBP. Officer didn't mention too much about I-94 expiry but main focus was on Pending asylum status. So now i am going to apply for consular process with advance parole that i got from pending asylum. Will inform NVC for third country consulate interview.

@ God is good savior of the world. even my I-94 is expire that is not much concerned by them. only the pending asylum is their main concern.

@ Mona A I applied through the lawyer. The problem was the lawyer because he didn’t prepare a proper draft or cover letter to explain it to the uscis officer all about this pending asylum status

when was your case denied and which office ?

case was denied on oct 27th. and it was philadelphia office

have u tried to reopening the case for a possible explanation

i have appointment on monday and tuesday with lawyers for applying for motion to reopen

@Guy are yiu aware of INA 245? if not ask lawyers on upcoming appointments and please keep us posted if you can

I am going to talk to the lawyer about INA 245-K. I know about that. The main problem was the Uscis officer didn’t even considered the pending asylum is a lawful if he doesn’t accept it as a lawful status then the INA 245-K is not eligible.

i have applied for i-824 and it is still in process. also got reply from us embassy in one of the european country. they agree to accept my case as third country national. so lets see when my case will move to Nvc and complete the process
