I filled out expedite request of I-765 on Jun 7
Jun 8 — received email for additional information
Jun 10 — responded by email with a bunch of supporting documentation
June 10 — expedite request approved
Fingers crossed for EAD approval as soon as possible

@d d, I think it’s less about which documents but more about which criteria. There are about 5 criteria which qualify anyone for expedite request. Once you identify 1 or 2 you think you can make a strong case around, write a well crafted, carefully organized letter to support those criteria. As you lay out your reasons, you will figure out which documents will make sense to support.
This was exactly my approach. Specifically I built my case around Clear USCIS Error and Severe Financial Loss to Self & US company.
1. Clear USCIS Error: my receipt date is ~2mths after case was delivered. I had kept all my FedEx tracking details including signed copy of application and picture of package to support this.
2. Severe Financial Loss: my employer wrote a letter showing how important my work is and how the company and clients will suffer great loss if I lose my job. Also, very difficult to find replacement for me if I’m terminated. All this was laid out in company letter head and signed by top company executive.
I got the help of a lawyer here on Lawfully who provided guidance. Hope this helps!

@Banji..could you please elaborate on how receipt date would fall under clear uscis error criteria? I have also provided employer letter indicating my importance at work, that didnt work. May i know the lawyer information and fees?

@d d, filed EAD application late Dec. Receipt notice was delayed and finally came in Mar. Instead of showing late Dec (the date the application was delivered per tracking details) as receipt date, it says Feb. That’s a clear error you can’t get them to correct. However you can use as a basis for expedite request.
One thing to note on employer letter isn’t just how important your work is. But you must also state how it benefits American lives/companies, provide specifics of financial loss to company and how hiring a replacement with your qualification and experience will be extremely difficult. As long as all those are true, and the company can defend it, I see no reason why they should deny.

@Banji O what type of EAD was yours? I have a pending I-539 for EAD approval..so I have used my employer letter for I-539 expedite, which they denied.

My EAD is based on pending I-485. I had the option to expedite my I-485 instead but I thought I had a stronger case with the I-765 so I chose that.

Lawyer is Adam Rodriguez. I only paid for consultation based on the advertized rates on Lawfully. But I scheduled multiple 15-min sessions. I still did all the work myself and did all the USCIS correspondence myself. His role was more consultative than representative.

Lol. Though I’m still curious to know how you raised the request and what reasons were stated? I doubt that they’ll advance the request so quickly if there’s no basis to do so.

I stated severe financial loss to person due to job loss. Agent asked me what all proof i can provide, I said lay off evidence, medical requirement, new offer in hand , mortgage at risk etc and gave details as much as I could type quickly. They said some one will get back in 5 days , but can be delayed too.

i gave valid reasons for expediting it and also i have been waiting since early nov even forca bio which is crazy to think when people in feb are getting their bio done and getting EAD’s

Hmm… I really can’t pretend to know how USCIS operates these days. Although mine is a green card-based EAD renewal. I’ve had 2 previously issued EAD/AP cards so perhaps that lessens the burden for proof.

l 131 expedite was approved, but nothing happend after that. I 765 still sitting on ‘ expedite request received ‘ status. 🙁

@I dreamer, congrats to you! Glad to know they approved your EAD expedite request also. Did you file expedite request of both I-131 and I-765?
My combo card arrived in the mail less than a week after expedite request of EAD was approved

Interesting! I didn’t even do expedite request of I-131 but that also picked up pace after it got approved. If it helps, see below my timeline after expedite request was approved.
June 10 — Expedite Request of I-765 approved
June 11 — New card is being produced
June 14 — I-765 and I-131 applications case approved
June 15 — card was mailed to me
June 16 — card was picked up by USPS
June 17 — card was delivered by USPS
Hopefully your follows similar timeline 😁

@d d, not sure I follow but in requesting expedited processing, I did mention that the receipt date in my receipt notice/online tracker did not match the date the application was physically received at the Lockbox.
