EAD C31 category
Hey guys, I have a question, since I didn’t file concurrently (I did but I guess my visa date wasn’t current so my I-485 was sent back but they kept my I-360) I want to know if I can still file ead under c31 category or should I just wait until they approve my I-360? I can’t really do much while waiting. I haven’t seen many people file ead under c31 category so I’m a bit confused as to the steps I need to take. P.S my husband is a LPR

when filing the VAWA there’s a selection you make for getting an EAD under C31 with a vawa approval. you don’t get the card until your vawa is approved. you can file separately but it’s unlikely to be approved without your vawa approval first

You can definitely file C31 EAD application since your VAWA is still in process. But I am confused, why did they send back your i485? Did they send a letter as to why they sent it back? VAWA based i485 has nothing to do with ‘current visa date’ because VAWA i485 has no cap on applications, whether the petitioner’s wife/husband is a PR or citizen.

you get EAD in 6months till your Vawa approve, once Vawa approve they automatically send you C31 EAD card

@sweet lins that’s what I’ve been told hence the reason I wasn’t too worried about it but people keep telling me I still need to file I-485 🤦🏽♀️

EAD c31 will only be sent after VAWA is approved. it comes automatic as a result of the VAWA approval. no need to file separately for EAD.
