Asylum grant date 01/2023 vs. I-94 date 10/2024 — which date matters for I-485/WOM?
Hello everyone, I wanted to ask this before, but I was holding myself back. Now I’m considering filing a mandamus because my I-485 has been pending for a long time. My timeline: • Asylum application (I-589): filed 03/2017 • Asylum interview: 10/2020 • My asylum approval notice was received in 10/2024. • However, the approval notice says: “As of 01/2023, you have been granted asylum in the United States pursuant to Section 208…” • My I-94 shows 10/2024. • I filed my I-485 in 11/2024. • My I-485 is still pending. My question is: What is my official asylum approval/grant date — 01/2023 or 10/2024? I’m asking because I’m considering filing a mandamus (WOM) in federal court. I’m concerned that if USCIS or the government looks at my I-94 date of 10/2024, they might argue that my asylum-based I-485 has only been pending since after that date. On the other hand, my actual asylum approval notice specifically says that I was granted asylum as of 01/2023. Has anyone had a similar situation where the asylum approval notice has one date but the I-94 shows a later date? For a mandamus case, which date would generally be relevant, and does the I-94 date change the effective asylum grant date? Thank you in advance for any information or experiences you can share.
