After 18 months denied us reason for denial is Indian Beneficiary's decree, we did provided them with divorce judgment,court order translation& they called divorce dcree & straight denied. #Suggestion
I'm US citizen and US army reservist My wife, an Indian beneficiary, and I filed our i130 application on August 16, 2023. We initially submitted the divorce decree from her previous marriage (which occurred in 2022) along with the court order when we applied. However, we later realized that we had uploaded the wrong documents.
In April 2024, we uploaded the correct court order from the Indian government, along with a certified English translation of the document.
In November 2024, we received an RFE (Request for Evidence) asking for the divorce decree. We resubmitted the same documents, thinking that USCIS may not have reviewed the ones we uploaded earlier. Unfortunately, our case was denied on January 31, 2025, after waiting 17.5 months.
We are now uncertain whether we should appeal the decision or reapply entirely. Any advice or suggestions would be greatly appreciated. Thank you!

file I-290B, Notice of Appeal or Motion with all correct and valid evidences . It will take only 90 days for decision. Either it will take more 15 to 18 months for new application.

sorry to hear about your denial, to be honest, I think consulting an immigration lawyer will be your best bet.. uscis always have issues with foreign divorce decree. what was the reason for the denial?

@v ik they mentioned in detail letter we need divorce decree and we have provided divorce decree.
we reached out to Indian court but we were told that's the max they can provide

I am also an Army Reservist. I recommend appealing your case and involving your senator's office for assistance as well. I apologize for the delays you’ve experienced. If you are currently in service, your case will be prioritized and should be resolved quickly. Personally, I involved my senator's office from the very beginning, and within less than a year, my spouse was able to join me in the United States.

I had the same terrible situation today, after 3.5 years waiting . Aug 24 interview , no result . June 25 asked me RFE , I submitted Early -my divorcee paper and an updated. i683 as requested.
today 11 Sept both denied , not sure what’s happening ? the divorcee paper we submitted from the beginning , during the interview and for the RFE ( 3 times )
