to Clarify: Is the RFE you received on July 30th related to Birth Certificate ? It shows that you responded to the RFE on Aug 17th. Or did you get a new RFE some time now ? I am asking for some Background Information. I am born In Saudi and I don't have a BC for the local authority there...neither they provide NAC... So as per the USCIS Title 8 of code of federal regulations 103.2 (b)(2)(ii) I submitted a Notarized Cover letter, drafted by me showing all my good faith attempts to recover the Birth Certificate (emails, affidavits) and the Secondary Evidences I have to proving my birth place (School Records, Consulate BC, Hospital Notification etc) along with Affidavits from Mom, Uncle and Aunt. I haven't received any query so far. I filed on 1st Feb 2021. Mine was tough as One might know how tough things can get in a Foreign country. But if nothing else works for you in India, please read the title I mentioned above and do accordingly. But please do lemme know if it's a second query that u received (July 30)

if you have a legitimate reason, it should be ok. I was born in India… adopted to Canada at a very young age. never had a birth certificate and my green card was approved in 5-6 months when I married my American hubby

wondering when u submitted rfe you need to go to court and get approval for birth certificate then the local office will issue it and this can take 3 to 4 months. Other options is to work with local office if they have not issued non availability letter they can do something for sure.

lol it’s India, the officials just want a bribe. For a basic passport renewal 53% of people report having to pay a bribe. Even if they can send the birth certificate, have it in their possession as we speak… they want a bribe first. This is the problem with India sadly

what is your priority date and what location

Application is at NBC, priority date is aug 2013, and location is MA, but rfe was posted from st thomas, virgin islands. how bizarre! haven’t heard of this place until now

hi Random query, thankyou for the information. my Aug 17 reaponse to rfe was for a 2 papers not signed on 485J supplement. I had signed them, looks like they were careless and lost them. I got EAD after that and 485J receipt, but the birth certificate rfe was on Sept 8, again I had submitted all similar documents mentioned by you. Looks like they are just not trained to chexk documents properly. Seems like it is a matter of luck if ones gets through .

yes got it just last week, and they say I should tey to submit before sept 30th to be eligible for this year quota. Why didn’t they give all rfes together? it’s ridiculous, I pay lawyer fees for each RFE

@gb pwl You are right... it's a matter of luck... but I'm still curious ? Did you submit a Notarized Cover Letter ? Did it include All the Good Faith Attempts. I included a Cover Letter (2 pages- Two Tables) Ist Table- Good Faith Attempts to retrieve the Document. (Near About 6 attempts with the Dates I tried- Also enclosed Proofs as Attachment) 2nd Table:- Secondary Evidences to Prove Birth In Saudi Arabia (6 documents to Prove Birth which had my name, parents name and Birth Certificate and 3 Affidavits from people mentioned earlier) Initially A paragraph explaining why I didn't have a local body issued birth Certificate. Additionally if it might help you... I'm an Indian citizen born in Saudi. So I also made a late registration Birth Certificate from The Panchayat ( it has my name, parents name, Place of Birth as Saudi) Let me know if this helps. I really wish it does. Again, as you said it depends on the officer there. To make the Indian Panchayat BC, it took nearly 2 months.

@gb pwl Good luck to you...Cover letter is a must! Please read the Title I mentioned earlier. Title 8 103. It has very good explanation. Will help you to answer the query more efficiently. Also the good faith Attempts. All the Best to you..🙏

Hi... Even though we have a lawyer, all the Cover letter drafting we did by ourselves,after thorough reading of the guidelines and some prior experience posted by people on various websites. If you can share your email here, I will share the Template of the Cover letter. Additionally, please keep in mind that we are also in the wait period and we haven't yet received our GC... neither any queries for the same yet. So we might not be the Ultimate answer, but happy to help you with what we did.

I got RFE for name issue in birth certificate on 9/17. submitted my affidavit and school certificate. let’s see what happens 🤞

So fingers crossed I'm hoping that the only query that should come now is the Medicals. I'll be surprised if anything related to BC comes.... lemme know how yours went...and if you responded with the cover letter and good faith Attempts ?

hi @Random Query! 😊 I did reply this week with letters as you suggested . It took about 10 days to get new affidavits etc. and medicals. Its all submitted, so I will update on what I hear back. congratulations on EAD approval. you should get medical request soon. So do call different places to get idea on how soon you can get appointment for blood tests. For me it took 5 days to finish it all.

I didn't receive any RFE yet for my BC... (I didn't have the actual BC...Applied with cover letter and other docs) . Sept 27th I received the EAD.... now fingers crossed 🤞 Praying that the only query that comes is Medicals.. hasn't come so far.....We hadn't submitted medicals initially...!!

not yet! final action date has retrogressed for EB3 to Jan 11, so they might keep applications on hold, my priority date is Aug 13.

gb pwl ... I received notification that Request for Additional Evidence is sent .... I can't wait to get my hands on it... I'm scared if it has to do anything with the birth certificate. I have a question for you... when you received ur query .. was it a RFIE or RF Additional ? Kindly answer

hi sorry for late reply @random query , I only got an Rfe and this was last year in Aug 2021. as of now, when I contacted uscis service agent sbout outcome and whether my birth certificate was accepted. They dont give a straight answer. She said “if you haven’t received anything other rfe, then they may not ask for now” This is still confusing to me, because my application is pending since 1.5 years. I dont know what the heck is going on.

Ai would say call the service agent and ask to speak to 2nd tier officer for your specific questions. you can also ask them to email you the digital rfe if it takes a long time to reach bu mail
