Regarding When Can Take Further Action On Case?
My wife had her citizenship interview on 4/28/21. It is my understanding that if a decision is not made within 120 days of the interview, you can take further action to ask the court for judicial review of the case to make a decision. However she received an RFE in late July, 2021. My wife responded to the RFE and USCIS confirmed receipt about a month ago in August, 2021.. I read that they are allowed to take up to 60 days to respond to the RFE. Does that mean we need to wait another month before we can start taking further action on the case? Or were they supposed to make a decision within 120 days of the interview regardless of the RFE and we can start taking further actions? Can anyone shed some clarity on this?

Nope... when you have a RFE, the process of your case is put on hold until you respond to that RFE and they will start reviewing your case back to 0

In my opinion, for Naturalization is very rare to receive a RFE. Usually, after your response the uscis has 60 days to respond it. After that, you can take action. As I have seen most of the time they send you a decision after your RFE response. Hope you have a good news soon .

My husband is in the same boat, he had his interview on 4-29-21, 3 months later he had a request for evidence and he responded to the request for evidence on 30-8-21 and still waiting for decision. My husband FO is Newark NJ, what FO is your wife case?

I'm in the same boat, had my interview for naturalization 07-1-2021 ,on July 13 I received RFE request, I responded on the 15 RFE was received, up till now no update on my case yet 🥲
