yes they can.
I am a green card holder and my husband I485got approved yesterday without interviews.
just make sure the marriage is legit and the beneficiary is in legal status

Yes, but it takes longer because the person is a green card holder. It would be faster if the person is a US citizen, but it’s possible!

Sandra was your husband in legal status for the entire duration of the process? Does a person only needs to be in legal status when you first file?

what if the husband/ wife is out of status???

@blessing it’s the entry that should be lawful. not necessary for the entire duration.

@n zay no you are wrong! I entered legally and missed 2 days of school and school under F1 visa. removed me from SEVIS. by the time my wife was a green card holder. I applied thru her I’ve got denied because of not attending to school timely. I waited her to become USC for 3 years. and I applied again on April 2022 still no decision.. don’t fall in in an illegall status in any case ever! stay legal whatever it takes!

@baris kurt I was referring to non student categories specifically. for F1 you would be in breach of your obligations as a student like you said.
