Port Of Entry Issues
After getting a Travel Document is it safes to travel my home country or not, Do I need face any immigration issues while entering to United States port of entry ?? Can you please anyone help me out !!

having your travel document does not guarantee your entrance back to the US. the CBP decides if he lets you enter or not. i suggest you have a valid reason why you travelled outside the US because the CBP will ask.

Idk why people say is not guaranteed. What is the reason to give a travel permission if you cannot travel and back?? No sense at all. Some people have to stop saying what they don't know. Yes, Rahul. You can travel to your country and back without any problems. Just pay attention on your case and don't stay out of the country for a long period. Also, if youre under asylum Do not travel to your country.

@Josh you seem to be the one saying what you don’t know. If there is serious grounds of inadmissibility on the part of the foreign national other than accrued unlawful presence then a CBP officer can deny entry. Always be sure of what you are saying before lashing out. i come in peace

In my opinion : AP allows you to travel while your case is pending. If have inadmissibility why the uscis give this document?. I agree, you cannot travel with AP if you are waiting for a decision after interview, if you're traveling to your home country if you ask for asylum. Other than that, you can travel with AP. I did it. Also, I traveled with my 18mo extension letter while I was waiting my i751 being schedule to an interview. Not problem at all

The CBP has arrested a bunch of people with AP in the past. They had serious inadmisibility grounds like drug charges and the likes. AP does not guarantee you entry as you are making it seem. Whether you have a pending case or not is not the only factor that is considered in letting you back into the United States.

Rocco. We are not talking about drugs charge, murderer or any crime. He asked if he can travel and back. If have any issue with crimes, now it's a different question

I am only correcting a notion like I said earlier. You sounded very confident that AP always guarantees people reentry so I needed to correct that opinion and you also lashed out which was very uncalled for.

Yes sir. I'm confident that you can travel with AP. Now if the person has criminal record that's is another question. Period

for clarification; josh bigosh is perfectly right. We all know that US citizens who have serious criminal issues get arrested too at the port of entry. And for parolees who have serious criminal issues, they will still admit them into the US (unless the parol was revoked while they were away) but will be promptly arrested based on the existing warrant of arrest and handed over to the appropriate law enforcement agency. PS: the rule used to be that paroles who acquired unlawful presence in the U.S. were only admissible at the sole discretion of the CBP officer. But there was a ‘subsequent’ judgment of the Board of Immigration Appeals that changed the former rule . Basically, the law now is unless in extreme or serious criminal offense, parolees are admissible…. Though, the CBP officer may ask you one or two questions before allowing you entry but they are usually just general questions to protect the US homeland just like they ask visa holders too.

gigi,if you have done interview and waiting for decision, it is not safe to travel, cos if decision come while outside, .Even if you get approved you Ap becomes invalid and can not bring you in.

@gigi I doubt that to be true. like it doesn’t make much sense that his AP ll be invalid. if he is still within the timeframe, and it’s not expired, he is still admiseable. Like what David said. I agree totally.

fact> a friend of mine went to Canadá with an advance parole, tried to come back and she got denied, reason > bc last time she came to the US stay more than she supposed to, then her case got canceled, now she started a new one but she being in Canada.

@javier Quinonez. that’s crazy though bcus everyone or I should say almost everyone with AP did overstay…. maybe she didn’t say the whole story or probs it was back then when it was at the CBP discretion.

@t Deen my FO is Miami. My case changed to "interview completed and case must be reviewed" the same day! It's been 17days now still no decision. So frustrating.. That's why I'm traveling back to my country see my family and think of something else!

What people don't seem to understand is that whether you have AP or not, the cbp officer you meet at the POE has your future in their hands. At that point, you cannot protest, you can do nothing. I know it's quite unlikely that the average person will be denied entry, but simply ask yourself if you're willing to take that risk. The choice is as always, yours to make. Thank you.

As I said. If you're clear you can travel with AP. But if have any criminal record or anything that can stop you at the border. Do not travel . Also, if the case is waiting for denial or approval I suggest not travel. Because if get denied can be a big issue when came back.

Quick update ,I travelled to Africa in November and came back second week of January. 2022.It was advance parole and I had overstayed before filing for adjustment of status, it is safe to travel if you don't have a criminal record. It is important to consult your attorney.
