yea they ask taxes my wife didn’t filed taxes jointly in 2017,2018 she was filing head of house hold n they reject on not filling jointly

is either you amend the taxes or file n400 alone under 5 years rule

you can go back and file an amended returns to comply with the laws. you can go back upto 2017 and file an amended returns. what was the reason for not filing as a joint or married filing separately? make sure no federal laws were violated to avoid taxes or to get EIC credits. another option is wait another 2 to 3 years and submit the n400 with joint tax returns.

Badshah, they don't care. it's between you and ur spouse to make sure that taxes are filed jointly. I'll recommend wait it out and apply again after 2 years (in 2023) with joint tax returns for 2021 and 2022. filing an amended returns will open up another pandora box with IRS for u and u shouldn't go that route especially if you have children. good luck! 👍

I think not 100% sure that you may be able to file an appeal now while you are waiting to hear back from IRS regarding amended tax returns. IRS will take between 6 to 8 weeks to process the amended tax returns and USCIS may take months to process ur appeal. once ur appeal gets a green light and ur called in for another interview. make sure to have additional documents such as joint bank statements, mortgage or lease agreements, insurance policies to prove that bone fide marriage exist. only joint tax returns is not gonna get u approved this time. just a thought! good luck brother 👍

@badshah the thing is my husband is in the process of his citizenship. his awaiting his interview. so I’ve been reading post and I ended up seeing that I have to correct the taxes cause he been filing as single and we’re married. so someone told us to correct immediately so that when he’s done with his citizenship and send in my stuff for the GC we won’t have any issues. so we now await irs to fix it.

yeah i hv appointment with attorney tomorrow might b we gona file appeal same day cz its 30 days time only cz i dont wana wait n waste my another 15 months

I see. I hope you get the help that you need soon. I was also worried about taxes...No one could tell me for sure and I didn't have a lawyer.
