Anyone Received a USCIS Response After an EB-2 NIW Inquiry?
Hi everyone, Is anyone else going through something similar with their EB-2 NIW case? I received an RFE in February, submitted my response in early May, and my case moved to Actively Reviewing the same day USCIS received the response. Since then, there have been no further updates. My attorney submitted a case inquiry for processing time delay, and USCIS replied saying the office has up to 60 days to respond. For those who have done an inquiry recently: Did you receive an actual response? How long did it take? Did it help move your case forward? I’d really appreciate hearing from anyone in the same situation or from those who already received an update after submitting an inquiry. Thank you!

inquiries never worked for me, not even from senator. I ended up paying premium processing, but I never got an RFE, it was just crazy long wait time to be assigned to an officer

I did it 2 times. First time they just answered accepting that my case has taken longer than usual. Second time they even did not answer. I hope in your case you get a better answer/ action.

inquiries don’t guarantee a decision, but they can trigger movement on a case depending on the situation. Just to clarify for everyone: ✅ When USCIS does respond to an inquiry USCIS only processes an inquiry when: The case is officially outside normal processing time, The inquiry is accepted into their system, and An officer is required to review the file to provide a status update. In these situations, the response is usually: A generic update like “your case is taking longer than expected”, or A confirmation that the case has been forwarded for review. This does not mean a decision, but sometimes this internal check can trigger movement, and shortly after, cases get approved or denied. (So an inquiry can indirectly lead to action, but it is not a guarantee.) ❌ When USCIS does not respond If the case is not yet eligible based on their processing-time calculator, USCIS will: Reject the inquiry silently, or Close it without sending a response. That’s why many people say they never heard back — their inquiry simply didn’t qualify. 🔍 Important An inquiry is not a request for a decision. It is only a request for status, but the review triggered by the inquiry may result in a decision if the file gets picked up by an officer.
